A Relative’s Visa is intended for applicants who are immediate family members of a South African citizen or permanent resident.
Eligibility
Dependent Children
Children of the principal applicant may be included on a Relative’s Visa, allowing the whole family to live together in South Africa.
Direct Family Members
As a direct relative of a South African citizen or permanent resident, you could qualify for a Relative’s Visa to reside in South Africa.
Financial Requirements
The South African citizen or permanent resident must provide sufficient financial assurance to the Department of Home Affairs to confirm that he or she can financially sustain the foreign national for the duration of the Visa.
Visa Validity And Renewal
A Relative’s Visa is issued for a period of up to 2 (two) years and may be renewed in country.
It is important to note that although a Relative’s Visa can be applied for in South Africa, the application must be submitted at least 60 (sixty) days before the foreign national’s current visa or port of entry stamp expires.
In cases where the foreign national has received a port of entry stamp/ visa that is valid for 30 days, the Relative’s Visa must be submitted at least 7 (seven) working days before the port of entry stamp/visa expires.
Work, Study And Business Restrictions
A Relative’s Visa does not permit you to conduct work, study, or business-related activities whilst in South Africa.
Therefore, should you wish to work, study, or have business authorisation included on your visa, you will be required to apply for a Visitor’s Visa in terms of section 11(6) of the Immigration Act, 2002 (Act No. 13 of 2002).
Work Authorisation
You will need a valid contract of employment from a South African based employer.
Business Authorisation
You will need proof that a suitable business structure is in place and that the business is registered for tax.
Path To Permanent Residence
Under the first step of kinship (your spouse/life partner) you will be able to apply for Permanent Residence, if you have been in a relationship with a South African citizen for at least 5 (five) years. Additionally, parents and dependant children are also eligible to apply for Permanent Residence in terms of section 27(g).
