Senegal Work Permit Process
The Senegal work authorisation process is specific to each foreign national and employing entity, depending on the nature of the assignment, the applicant’s role and the compliance requirements of the Senegalese employer.
The process to legally live and work in Senegal generally involves three key stages:
- Business Visa
- Work Permit
- Residence Permit
Types of Permits
BUSINESS VISA
The Business Visa is the first stage of the Senegal work authorisation process and allows the foreign national to enter Senegal for legitimate business-related purposes. Where a visa is required based on the applicant’s nationality, it must be obtained prior to travel to Senegal. Senegal’s Ministry of Foreign Affairs confirms that entry visa requirements differ according to nationality.
Importantly, the Business Visa also facilitates the next stage of the work authorisation process. The medical certificate required for the Work Permit application must be completed in Senegal. Senegalese authorities recognise medical certificates issued by doctors registered with the Senegalese National Order of Physicians.
Accordingly, the applicant is required to travel to Senegal Work Permit application can be submitted. The Business Visa therefore provides the appropriate initial entry route, allowing the applicant to enter Senegal and complete the required in-country medical examination before proceeding with the Work Permit application.
The Business Visa should not be regarded as the applicant’s long-term work authorisation. Rather, it serves as the initial entry stage that enables the applicant to complete the necessary in-country formalities required for the subsequent Work Permit process.
WORK PERMIT
The Work Permit is the formal authorisation required for a foreign national to undertake employment in Senegal and forms the second stage of the immigration process.
The application is supported by both the foreign national and the Senegalese employer and is linked to the applicant’s local employment. As part of the process, the applicant is required to undergo the prescribed medical examination in Senegal and obtain the relevant medical certificate. Senegalese labour legislation also provides for regulatory oversight of employment contracts requiring a worker to establish themselves outside their habitual residence, including medical and labour-authority requirements.
The Work Permit may be issued for a period of up to two years, depending on the employment arrangement and approval granted.
Once issued, the Work Permit provides the foreign national with the required employment authorisation. Where the individual will reside in Senegal for the duration of the assignment, the applicant must thereafter proceed with the Residence Permit process.
RESIDENCE PERMIT
The Residence Permit forms the third stage of the process and provides the foreign national with the appropriate immigration status to legally reside in Senegal for the duration of their assignment.
The Residence Permit application follows the successful issuance of the Work Permit and is undertaken in Senegal. The application is linked to the applicant’s lawful employment and residence in the country and requires evidence of the approved Work Permit together with the relevant local residence formalities.
Once issued, the Residence Permit should be maintained together with the applicant’s Work Permit for the duration of the assignment. The two authorisations serve different but complementary purposes: the Work Permit authorises the foreign national to undertake employment, while the Residence Permit authorises the foreign national to reside in Senegal.
Key Considerations
A key consideration is that the medical certificate required for the Work Permit process must be obtained in Senegal. The foreign national must therefore travel to Senegal as part of the process, which is why the Business Visa forms an important initial stage for applicants who require a visa to enter the country.
Employers and foreign nationals should therefore plan the assignment and travel arrangements carefully to ensure sufficient time for the applicant to enter Senegal, complete the required medical examination, proceed with the Work Permit application and thereafter regularise their longer-term residence status through the Residence Permit process.
